A High Court in Mombasa has ordered the electoral commission to accept the nomination of former Nairobi Governor Mike Sonko.
Additionally, Sonko, who is vying for the governor of Mombasa position, was told to inform the Independent Electoral and Boundaries Commission (IEBC).
The court found that the IEBC’s decision to disqualify Sonko from the race was unreasonable.
“They violated the Constitution and rushed with the announcement,” the court ruled.
IEBC has requested to lodge an appeal against the judgement.
Justices Sewe, Ong’injo, and Githinji concluded in their hour-long decision that IEBC had infringed the petitioner’s rights.
“The County Returning Officer acted unreasonably and in a rush in her decision to disqualify the petitioner,” Sewe said.
The three justices commanded the IEBC to accept Sonko’s nomination papers immediately immediately and see to it that he is gazetted in time for the general election on August 9.
IEBC had already cleared and gazetted seven candidates; Abdulswamad Nassir (ODM), Hezron Awiti (VDP), Hassan Omar (UDA), William Kingi (PAA), Daniel Kitsao (Independent), Shafii Makazi (Upia), and Said Abdhalla (Usawa) for Mombasa governor race.
