The application was done by Brian Khaemba on her behalf on Wednesday, October 5, during the pre trial conference confirming that he received instructions from her.

Ngirici had move to Court challenging Waiguru’s win in the just concluded polls, claiming that the election was marred with irregularities.

The former Woman rep, who ran as an independent candidate, was given seven days to formally withdraw case.

“I make the application through rule 21. I have received instructions from my client to withdraw the case,” stated Khaemba.

In her petition she filed in early September at Kerugoya Court, Ngirici argued that she had evidence to prove that the election results were manipulated in favour of her competitor.

She lost the race after garnering 105,667 votes against Waiguru who got 113,088 votes.

The suit named Independent Electoral and Boundaries Commission (IEBC) as the main respondent with Waiguru named as third respondent alongside her deputy David Wachira Githanda who was the fourth respondent.

Kamau Waiganjo, who represented Governor Waiguru in the suit, expressed his gratitude to the petitioner’s team noting that the move will boost service delivery in the county.

He added that unlike the 2017 suit filed by Martha Karua that proceeded to the East African Court, the withdrawal of the latest suit would enable the county to run uninterrupted.

“We are happy that the petitioner has withdrawn the case. Kirinyaga people are going to be served without any disturbance,” explained Waiganjo.
