Justus Nyang’aya, one of the four dissenting commissioners of the Independent Electoral and Boundaries Commission (IEBC) has alleged that a foreigner had access to the servers from June 1.
The commissioner who filed a response to the Raila Odinga and Martha Karua petition added that the foreigner infiltrated IEBC’s servers and manipulated Forms 34A from the polling stations.
“That I am also aware that after the previously pulled down results were uploaded afresh there would be amendments for Form 34B,” his affidavit read in part.
Nyang’aya also alleged that the IEBC chairperson, Wafula Chebukati, worked with three IEBC staff to manipulate the presidential results. Chebukati was said to have recruited the staff to tamper with the results uploaded from tallying centres across the country.
The trio, Nyang’anya claimed were Abdidahir Maalim, Moses Sunkuli and Gideon Balang. The three accused persons are yet to file a response in relation to the commissioner’s claims.
“These are the same officers who were helping Chebukati to unilaterally process the results, that he subsequently declared,” the commissioner claimed.
In his affidavit, Nyang’anya further told the Supreme Court that logs obtained from the IEBC servers can prove that the three staff members and the foreigner interfered with the data.
His petition comes a few days after Azimio la Umoja presidential candidate Raila Odinga and his running mate Martha Karua presented a written form of their petition at the apex court detailing how the election was bungled.
Raila and Karua disclosed that 19 foreigners and two Kenyan nationals intruded and tampered with the IEBC systems. The two alleged that the scheme was orchestrated in March 2022.
They added that the interference resulted in the manipulation of results and led to William Ruto being declared President-elect. The duo want Supreme court to annul the presidential results, tally the votes and announce them as president-elect and deputy president-elect respectively.
IEBC in its response argued that the elections were transparent, free and fair and also maintained that the system was not hacked as alleged.
Ruto also dismissed Raila’s allegations in the response filed at the Supreme Court on Friday August 26.
Using ID ‘0’, the accused would infiltrate the system at night and reportedly pull down the uploaded results and replace them with new ones.
He further accused the non-native of intercepting Forms 34B and altering them before re-uploading them afresh.
