The Judicial Service Commission (JSC) has been temporarily barred from hiring new judges for the court of appeals and the high court by the high court.
For the positions of judges of the court of appeal and the high court, JSC had shortlisted candidates for interviews earlier this month.
Justice Antony Mrima issued conservatory orders this morning, prohibiting JSC from taking any further action, including inviting, considering, evaluating, deliberating, or interviewing applicants for appointment to the court of appeal and high court.
Judge Mrima has stated that while there is a need for more judges in the superior courts, the recruiting process itself must comply with and be within the constitution, otherwise it will be void.
Katiba Institute has sued CJ Martha Koome and JSC, requesting that the recruitment of new judges be suspended until the 6 judges are appointed.
